What this is. The Survey-Ready Replacement Promise is a limited sales promotion offered by EPP Posters to U.S. purchasers only. It is not a warranty of regulatory compliance, insurance, indemnification, a guarantee of any survey outcome, or legal, medical, or regulatory advice. Our posters are educational reference materials and do not by themselves satisfy any obligation under 42 C.F.R. Appendix Z, the CMS Emergency Preparedness Rule, State Operations Manual Appendix Z guidance, or the standards of any Accrediting Organization (including, without limitation, The Joint Commission, DNV, HFAP, CIHQ, or ACHC). You remain solely responsible for your facility’s Emergency Preparedness Program, policies, training, exercises, and posted communications.
Eligibility. Original purchaser located in the 50 U.S. states or D.C.; poster displayed unaltered, in the location and manner recommended; and a written survey report or statement of deficiencies from CMS or a CMS-approved Accrediting Organization that specifically identifies content printed on our poster as a cited deficiency that we did not first offer to correct or replace at no charge.
Sole and exclusive remedy. One (1) free replacement poster of equal or lesser value per qualifying order. No cash refunds, credits, chargebacks, reimbursement of fines, penalties, plan-of-correction costs, consulting fees, legal fees, lost revenue, or consequential, incidental, special, indirect, or punitive damages of any kind. To the maximum extent permitted by law, our aggregate liability relating to this promise will not exceed the amount you paid for the poster at issue.
Exclusions. Improper installation or placement; missing, altered, defaced, or handwritten content; failure to install an update we made available; buyer-supplied incorrect facility information; citations unrelated to poster content (e.g., policies, drills, training, HVA, COOP, staffing, recordkeeping, life-safety, physical plant); citations issued before purchase or after superseding regulatory changes; and any matter not directly and solely caused by content we printed.
Claims. Submit a written claim within 30 days of the survey report date, including a copy of the report and proof of purchase, to the address on your order confirmation. Void where prohibited or restricted by law. Offer is limited, may be modified or discontinued at any time, and is governed by the laws of the State in which EPP Posters is organized, without regard to conflict-of-laws principles. Nothing in this promise limits any non-waivable rights you may have under applicable consumer-protection or state law.
